Mediation
Mediation is a form of alternative dispute resolution where both parties and their attorneys attempt to negotiate an agreement resolving the issues in their divorce. A mediator is present and helps to facilitate the mediation. A mediator is neither a judge nor an arbitrator and cannot issue orders upon the parties. The sole purpose of the mediator is to help the parties see each other’s points of view, offer suggestions or possible resolutions, and provide a neutral person’s opinion on how a judge will perceive and resolve this case. A mediator can be helpful when one or both parties are being unreasonable or unrealistic. A mediator’s fees are similar to that of an attorney and are typically split between the parties. Some Atlanta counties, including Fulton and Cobb counties, require that parties involved in contested divorce proceedings attend mediation. Where parties cannot afford mediation fees arising from court-ordered mediation, they can request the mediator’s fees be waived or paid for by the county.
